Terms and Conditions

The following are the definitions of the following terms:

• Tatmeen ("Company" or "Website" or "we" or "us"): Tatmeen Healthcare Company ltd.

• Service Provider ("Consultant" or "Advisor"): The physician or therapist.

• Service Recipient ("User" or "Client" or "Beneficiary"): The individual seeking psychological or family consultation.

• These terms and conditions are between Tatmeen ("Company" or "Website" or "we" or "us"), the Service Provider ("Consultant" or "Advisor"), and the Service Recipient ("User" or "Client" or "Beneficiary"). The following terms and conditions, along with any incorporated documents referred to as "Terms and Conditions" or "Terms of Use," grant the User access to the Tatmeen application and its use, including any content, features, and services offered on or through Tatmeen, whether as a guest or a registered user. A registered user is any person who registers with Tatmeen in any capacity.

• Please read these terms and conditions carefully before using Tatmeen. By using Tatmeen or clicking "Accept" or agreeing to the "Terms and Conditions," the User agrees to be bound by these terms and conditions and our privacy policy, which is incorporated herein by reference. If the User does not wish to agree to these terms and conditions, they must not download, use, or delete Tatmeen.

• Tatmeen is available to users who are 18 years of age or older. By using Tatmeen, the User represents and warrants that they are of legal age to form a binding contract with the Company and meet all the foregoing eligibility requirements. If they do not meet all these requirements, they must not download, use, or delete Tatmeen.

- We may revise and update these terms and conditions from time to time at our sole discretion. All changes are effective immediately upon posting and apply to the continued use of Tatmeen thereafter.

- The User's continued use of the Tatmeen application after the posting of the amended terms and conditions means that they accept and agree to the modifications. It is advised to check this page each time the User accesses Tatmeen to review any amendments as they are binding.

• We reserve the right to withdraw or modify Tatmeen and any service or material we provide through it at our sole discretion and without notice.

• We will not be liable if all or any part of Tatmeen is unavailable at any time or for any period.

• We may restrict access to certain parts of Tatmeen or the entire Tatmeen application from time to time for users, including registered users.

- We reserve the right to withdraw or modify Tatmeen and any service or material we provide through it at our sole discretion and without notice.

- We will not be liable if all or any part of Tatmeen is unavailable at any time or for any period.

- We may restrict access to certain parts of Tatmeen or the entire Tatmeen application from time to time for users, including registered users.

- Taking necessary arrangements to access Tatmeen.

- Ensuring that all individuals accessing Tatmeen through their respective internet are aware of and comply with the terms and conditions.

- To access Tatmeen or certain resources provided by it, we may request the user to provide specific registration details or other information.

- A condition of using Tatmeen is that all information provided on Tatmeen is accurate, up-to-date, and complete, that the user agrees that all information provided for registration on Tatmeen or otherwise, not exclusively through the use of any interactive features on Tatmeen, is subject to our privacy policy, and agrees to all the procedures we take regarding their information in accordance with our privacy policy.

- If the user chooses or is provided with a username, password, or any other piece of information as part of our security procedures, they must treat such information as confidential and must not disclose it to any person or entity. They also acknowledge that their account is personal and agree not to grant any other person access to Tatmeen or any part thereof using their username, password, or other security information.

- They agree to notify us immediately of any unauthorized access or use of their username, password, or breach of security. They also agree to ensure that they log out of their account at the end of each session. They should exercise particular caution when accessing their account from a public or shared computer to prevent others from viewing or recording their password or other personal information.

- We reserve the right to disable any username, password, or any other identifier, whether chosen by the user or provided by us, at any time in our absolute discretion for any reason or no reason if we believe it violated any of these terms.

Tatmeen may contain message boards, chat rooms, personal web pages or profiles, forums, and other interactive features (collectively, "Interactive Services") that allow users to post, submit, display, or transmit to other users or persons (hereinafter, "post") content or materials (collectively, "User Contributions") on or through Tatmeen.

All user contributions must comply with the content standards set out in these terms and conditions. Any user contribution posted on the site will be considered non-confidential and non-proprietary. By providing any user contribution on Tatmeen, the user grants us and our affiliates and service providers, and each of their respective licensees, successors, and assigns the right to use, reproduce, modify, perform, display, distribute, and disclose to third parties any such material.

The user represents and warrants that:

• They own or control all rights in and to the user contributions and have the right to grant the license granted above to us and our affiliates and service providers, and each of their respective licensees, successors, and assigns.

• All of the user contributions comply with these terms and conditions.

• They are solely responsible for any user contributions they submit or contribute, and they, not the company, bear full responsibility for such content, including its legality, reliability, accuracy, and appropriateness.

• We are not responsible or liable to any third party for the content or accuracy of any user contributions posted by the user or any other user of Tatmeen.

We reserve the right, without limitation, to do the following. We have the right to fully cooperate with any law enforcement authorities or court order requesting the disclosure of the identity or any other information of any person who publishes any materials on Tatmeen or through it. The user waives the company and its subsidiaries from any claims arising from an action taken by the company or any previous parties.

However, we cannot review all materials before they are posted on Tatmeen, and we cannot guarantee the immediate removal of rejected materials after they have been posted. Accordingly, we assume no responsibility for any action or inaction regarding the transmission, communications, or content provided by any user or third party. We assume no responsibility towards any person for the performance or non-performance of the activities outlined in this section.

• Removal or refusal to publish any user contributions for any reason or without reason, in our sole discretion.

• Take any action regarding any user contribution that we deem necessary or appropriate, in our sole discretion, if we believe that such user contribution violates the terms and conditions, including content standards, or infringes any intellectual property rights or any other rights of any person or entity, threatens the personal safety of Tatmeen users or the public, or may create liability for the company.

• Disclose the user's identity or other private information to any third party claiming that the materials posted by the user violate their rights, including their intellectual property rights or their right to privacy.

• Take appropriate legal action, including but not limited to, referral to law enforcement, for any unlawful or unauthorized use through Tatmeen.

• Terminate or suspend a user's access to Tatmeen in whole or in part for any reason or without reason, including but not limited to, any violation of these terms and conditions.

These content standards apply to all user contributions and interactive services. User contributions must fully comply with all applicable local and international laws. Without limiting what we have provided, user contributions must not:

• Contain any defamatory, obscene, indecent, abusive, offensive, violent, hateful, or unacceptable materials.

• Promote sexually explicit or pornographic materials, racial, sexual, religious, national, disability, sexual orientation, or age discrimination.

• Infringe any patent, trademark, trade secret, copyright, or other intellectual property rights or other rights of any other person.

• Violate legal rights, including advertising and privacy rights, of others or contain any materials that may give rise to civil or criminal liability under applicable laws or regulations or that may conflict with Tatmeen's terms and conditions and privacy policy.

• Deceive any person.

• Encourage any unlawful activity or advocate, promote, or assist in any unlawful act.

• Cause needless annoyance or inconvenience or is likely to harass or embarrass any other person.

• Impersonate any person or misrepresent the user's identity or affiliation with any person or organization.

• Engage in commercial or sales activities, such as contests, gambling, or other promotional sales offers or exchanges or advertisements.

• Give the impression that it emanates from us or is endorsed by us or any other person or entity, if it is not the case.

You acknowledge and warrant the following:

• Your use of Tatmeen has never been disabled or prevented at any time.

• Any misuse by the user outside the scope of the stated relationship will result in immediate suspension of their account.

• You are 18 years of age or older to be able to receive services on Tatmeen.

Tatmeen shall only be used for personal purposes and in accordance with the terms and conditions set forth on the Tatmeen website. The user undertakes and agrees not to use Tatmeen in the following cases:

• In any manner that violates any applicable law or regulation, including but not limited to any laws relating to data or software export.

• For the purpose of exploiting minors, causing harm to them, attempting to exploit or harm them in any way, including by exposing them to inappropriate content or requesting personal identification information or any other means.

• To send, receive, download, use, or reuse any material that does not comply with the content standards specified in these terms and conditions.

• To send or purchase any advertising or promotional materials (without our prior written consent), including "spam," "chain letters," "junk mail," or any other similar requests.

• To impersonate or attempt to impersonate the company, any of its employees, another user, or any other person or entity (including but not limited to using email addresses or screen names associated with any of the foregoing).

• To engage in any other behavior that restricts or prevents any person from using Tatmeen, or that, as determined by us, may harm the company or Tatmeen users, or expose them to liability.

In addition, the user agrees not to:

• Use Tatmeen in any manner that could disable, overburden, damage, impair, or interfere with the functioning of the website or any other party's use of Tatmeen, including their ability to engage in real-time activities through Tatmeen.

• Use any robot, spider, or other automatic device, process, or means to access Tatmeen for any purpose, including monitoring or copying any of the materials on Tatmeen.

• Use any manual process to monitor or copy any of the materials on Tatmeen, or for any other purpose not expressly authorized in these terms and conditions, without our prior written consent.

• Use any device, software, or routine that interferes with the proper functioning of Tatmeen.

• Introduce any viruses, Trojan horses, worms, or other harmful materials.

• Attempt unauthorized access to any part of Tatmeen, interfere with, damage, disable, or disrupt any computer server, on which Tatmeen is stored, or any connected database.

• Attack Tatmeen through denial-of-service attacks or distributed denial-of-service attacks.

• Attempt to interfere with the proper working of Tatmeen.

• You will review and comply with any notices sent through Tatmeen regarding your use of the service provided by Tatmeen.

• You will not use the information, content, or any data received or obtained through Tatmeen services for any other purpose except for personal use, and you will use Tatmeen and the service exclusively for your own purposes and will not sell them to any third party.

• You will not use the service or Tatmeen to cause harm, harassment, or annoyance to anyone.

• You will keep your account password or any identification means provided to you for accessing your account secure and confidential.

• You will not hinder the proper functioning of Tatmeen.

• You will not attempt to damage the service or Tatmeen in any way.

• We have made every effort to maintain the proper operation and functionality of the website, but Tatmeen shall not be liable and we will not be subject to any claims for temporary unavailability of the website due to technical problems beyond our control.

You can review the prices on Tatmeen for each service before placing an order, based on the duration you choose, either 30 minutes, 45 minutes, or 60 minutes. The prices will be visible on the profile page of each service provider (physician or therapist). The price may vary depending on the qualifications and years of experience of the service provider (physician or therapist), who has the right to modify the price whenever they want. The session price will be updated accordingly.

- Tatmeen reserves the full right to impose new fees at any time for the use of Tatmeen or the service, or both.

- You are required to pay the service fee (session fee) to Tatmeen when booking an appointment with the service provider (physician or therapist).

- Available payment methods within the platform include debit and credit cards: Mada, Visa, Mastercard, and Apple Pay.

• The session fee will be refunded to the user in the following cases:

• The user is entitled to request a full refund of the paid amount before 6 hours prior to the session.

• The user is entitled to request a full refund of the paid amount if the service provider (physician or therapist) fails to attend the session without any prior excuse.

• The user is not entitled to a refund of the session fee or any portion thereof if the user requests to terminate the session during its scheduled time.

• The user is entitled to request a full refund of the paid amount in the event of a technical malfunction from Tatmeen.

• The user cannot request a refund after completing the appointment or session.

• The full cost of the session will be refunded if the appointment is canceled by the service provider (physician or therapist) and the user does not wish to transfer the session booking to another advisor or keep the amount in the user's wallet within Tatmeen.

• If the user requests to cancel appointments within a purchased package after receiving one or more sessions from the package without completing the remaining sessions, the completed session will be charged at its original price without any discount, and the remaining amount will be refunded to the user's financial wallet.

• In case of any technical issue during the session, please contact the customer service team at Tatmeen to complete the session. If it is not resolved, the user will be compensated with another appointment or session with the same advisor.

• If the user requests a refund to their bank account, the transfer process may take from 21 to 28 business days.

When purchasing a package of multiple sessions, you are buying a predetermined number of sessions at a discounted price, and you can benefit from these sessions within a limited time period. Please note that packages are non-refundable. Once the package is purchased, it is your responsibility to fully consume the package before the expiration date.

• The information, recommendations, and services provided to you through the website or Tatmeen are for the purpose of facilitating the requested service.

• Tatmeen will make reasonable efforts to maintain the accuracy and updating of the website, Tatmeen, and its contents, without prejudice to the developmental aspect.

• Tatmeen shall not be held responsible for any damages resulting from the use of, or the inability to use, the website or Tatmeen, including damages caused by malware or viruses. Tatmeen also disclaims responsibility for the accuracy or completeness of the information on the website or Tatmeen, unless such damages result from intentional misconduct or gross negligence on the part of Tatmeen.

• Tatmeen shall not be held responsible for any damages resulting from the user sharing their contact information with the service provider (physician or therapist).

You guarantee that any part of your profile does not violate the rights of others or violate any laws or regulations. Tatmeen reserves the right to take action against any violation of these rules, including deleting prohibited content from the user's profile or taking any other action, including legal action. Additionally, you agree not to engage in the following:

• Using Tatmeen in an unlawful manner or in a way that could harm, disable, or impair the website.

• Using automated scripts to gather information from the website.

• Using Tatmeen services for fraudulent purposes.

• Distributing or storing illegal content on Tatmeen.

• Impersonating, forging, or misrepresenting any person's identity or affiliation or creating a false identity.

• Publishing third-party personal data, such as addresses, phone numbers, email addresses, or credit card numbers.

Tatmeen does not provide any warranties, whether express or implied, regarding the services, and all services are provided "as is."

The information provided on or through Tatmeen is solely for general informational purposes. We cannot guarantee the accuracy, completeness, or usefulness of this information. Any reliance you place on this information is at your own risk. We disclaim all liability arising from any reliance on materials published by users, visitors, or any other person who may be aware of any of its contents.

Tatmeen includes content provided by third parties, including materials provided by other users, bloggers, licensed third-party providers, and/or reporting services. All data and/or opinions expressed in these materials, as well as all articles, answers to questions, and other content, except for the content provided by the company, are solely the opinions and responsibility of the person or entity providing these materials. These materials do not necessarily reflect the opinion of the company. We are not responsible for you or any other party for the content or accuracy of any materials or services provided by any external parties.

All purchases made through our website or other transactions involving the sale of goods or services, or information generated through Tatmeen or resulting from user visits, are subject to our pricing schedules, which are included under these terms and conditions.

Users may integrate the main website with social media platforms, provided it is done in a fair and lawful manner that does not harm our reputation or exploit it. However, such integration shall not occur without our prior written consent. Tatmeen may provide certain social media features that enable users to:

• Link specific content within Tatmeen to their own applications or certain external applications.

• Send email messages or other communications with specific content or links to specific content on Tatmeen.

• Cause limited portions of the content to be displayed on Tatmeen or appear on their own applications or certain external applications.

• Use these features only as provided by us, in relation to the content being displayed.

• Comply with any additional terms and conditions we provide regarding these features. Subject to the above, the user must:

• Create a link from any application they do not personally own.

• Cause Tatmeen or a portion of it to be displayed or appear on any other website, for example, through framing, deep linking, or direct linking.

• Link to any part of Tatmeen other than the homepage.

• Otherwise, take any action regarding the materials on Tatmeen that does not comply with any other terms and conditions.

• Tatmeen, from which the link is made, or which provides access to specific content, must comply with the content standards set forth in the terms and conditions.

• They must agree to cooperate with us in immediately discontinuing any unauthorized framing or linking. We reserve the right to withdraw linking permission without notice.

• We may disable any or all features related to social media networks and any links at any time without notice, at the discretion of Tatmeen.

If Tatmeen contains links to websites and resources provided by external parties, these links are provided and made available to the user. This includes links found in advertisements, including banner advertisements and promotional links. We have no control over the contents of those websites or resources and accept no responsibility for any loss or damage that may arise from their use.

Tatmeen is operated by Tatmeen Healthcare Company in the Kingdom of Saudi Arabia, and we provide Tatmeen for use only by individuals residing in the Kingdom of Saudi Arabia. We do not claim that Tatmeen or any of its content is accessible from outside the Kingdom of Saudi Arabia. Access to Tatmeen may not be legal by certain individuals or in certain countries. If the user accesses Tatmeen from outside the Kingdom of Saudi Arabia, they do so on their own initiative and are responsible for compliance with local laws.

• It should be understood that we cannot guarantee that the files available for download from the Internet or Tatmeen are free of viruses or other destructive codes. The user is responsible for implementing sufficient procedures and checkpoints to meet their particular requirements for virus protection and accuracy of data input and output, and for maintaining a means external to our site for reconstruction of any lost data.

• To the maximum extent permitted by law, we shall not be liable for any loss or damage arising from distributed denial-of-service attacks, viruses, or other technologically harmful materials that may infect the user's computer equipment, computer programs, data, or proprietary material due to the use of Tatmeen or any services or items obtained through Tatmeen or to downloading any material posted on it or on any website linked to it.

• The use of Tatmeen, its content, and any services or items obtained through Tatmeen is at your own risk. Tatmeen, its content, and any services or items obtained through Tatmeen are provided on an "as is" and "as available" basis, without any warranties of any kind, whether express or implied.

• The company and any person affiliated with the company do not warrant or represent that Tatmeen, its content, or any services or items obtained through Tatmeen will be accurate, reliable, error-free, or uninterrupted, that defects will be corrected, that our site or the server that makes it available will be free of viruses or other harmful components, or that Tatmeen or any services or items obtained through Tatmeen will meet the user's needs or expectations.

• To the maximum extent permitted by law, the company disclaims all warranties of any kind, whether express or implied, statutory, or otherwise, including but not limited to any warranties of merchantability, non-infringement, and fitness for a particular purpose.

• The foregoing does not affect any warranties that cannot be excluded or limited under applicable law.

To the maximum extent provided by law, the company, its subsidiaries, affiliated service providers, employees, officers, directors, contractors, shall not be liable for any damages of any kind under any legal theory arising out of or in connection with the use of Tatmeen and any associated applications, nor shall they be liable for any content on Tatmeen, including any direct, special, incidental, consequential, or punitive damages, including but not limited to personal injury, emotional distress, loss of revenue, loss of profits, loss of savings or data, loss of use, loss of reputation, or any other damages whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

The above limitation of liability does not apply to liability arising from our willful misconduct. The foregoing does not affect any warranties that cannot be excluded or limited under applicable law.

The user agrees to defend, indemnify, and hold harmless the company, its subsidiaries, affiliated service providers, employees, officers, directors, contractors, agents, licensees, successors, suppliers, and assignees from and against any claims, liabilities, obligations, damages, judgments, awards, losses, costs, expenses, or fees (including attorneys' fees) arising out of or relating to a violation of these Terms and Conditions or the use of Tatmeen, including but not limited to the user's own contributions, any individual use of Tatmeen's content, services, and products beyond what is permitted by these Terms and Conditions, or the use of any information obtained through Tatmeen.

You acknowledge sole responsibility for the privacy of the services provided to you and you are solely responsible for their use by any other person using your account and/or username or password or access credentials.

You agree to notify Tatmeen promptly upon becoming aware of any loss, theft, or unauthorized use of any password, username, IP address, or other access methods to the services.

Tatmeen reserves the right, in its sole discretion, to modify any term of these Terms of Use or replace them, or change the service or Tatmeen or suspend or terminate them, including but not limited to (providing any feature, database, or content) at any time, by posting notice on the website, sending notice to you through the service or Tatmeen, or via email.

Tatmeen may impose limits on certain features and services or restrict your access to parts or all of the service without notice or liability.

• When using Tatmeen services, we or one of our partners may place cookies on your system. Cookies are small pieces of data that we send to your browser from a website and are stored on your system for general record-keeping purposes. Cookies make the internet more useful by storing information about your preferences on a particular system, in addition to cookies.

• We use a variety of other technologies, including web beacons, animated images, or other forms of technology present in your Tatmeen system, to collect information about how users interact with Tatmeen services.

• Cookies and other technologies help personalize the service provided to you and help link your interaction with our services to the information in your personal account. They can give us an indication of the most popular pages, conversion rates, viewing patterns, clicks, and other information that can help us develop, operate, and monitor our website and other services.

• The Help button in the toolbar of most browsers can help you prevent the acceptance of new cookies, show you a message from the browser about new cookies, or disable the cookie service.

• If your web browser does not accept any type of cookies, you will not be able to use Tatmeen or any of its services.

All intellectual property rights in Tatmeen services and all materials related to them or appearing within Tatmeen are the property of Tatmeen, whether registered or unregistered in Tatmeen. All content and design information contained in Tatmeen is the property of the Tatmeen platform, including, but not limited to: text, graphics, software, images, videos, music, sound, and their selection and arrangement, as well as all software compilations, source codes, and core programs.

You must not allow anyone, for any reason, to use your account for a session or benefit from any service provided by Tatmeen.

The company name "Tatmeen" and all related names, product names, service names, designs, graphics, terms, and conditions are trademarks of the company or its subsidiaries or licensed entities. These trademarks should not be used without prior permission from the company. All other names, logos, product names, service names, and other designs in Tatmeen are trademarks of Tatmeen.

Under no circumstances may the content of the website be modified, copied, distributed, framed, reproduced, downloaded, published, referred to, or sold in any form or by any means, wholly or partially, without obtaining prior written consent from Tatmeen. In the event of a breach of this condition, the company may terminate the right to use at any time without notice.

Tatmeen may send a notice by sending a general notice about the service or Tatmeen, or by sending an email to your registered email address in your Tatmeen account information, or by sending a letter by regular mail to your registered address in your Tatmeen account information.

All matters relating to Tatmeen and these terms and conditions, and any dispute or claim arising out of or in connection with them (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any legal action or proceeding arising out of or related to the terms and conditions and the privacy and integrity policy of Tatmeen shall be exclusively brought in the competent courts of the Kingdom of Saudi Arabia.

Any cause of action or claim related to or arising out of these terms and conditions or Tatmeen, must commence within one (1) calendar year after the actual accrual of such cause of action; otherwise, such action or claim is permanently barred.

No waiver by the company of any provision set forth in the terms and conditions shall be deemed a further or continuing waiver of such term or any other term, and the company's failure to assert any right or provision under the terms and conditions and the privacy and integrity policy shall not constitute a waiver of such right or provision.

These terms and conditions and our privacy and integrity policy constitute the sole and entire agreement between the "User," "Tatmeen," and the "Service Provider" regarding Tatmeen and supersede all prior understandings, agreements, representations, and warranties, whether written or oral, regarding Tatmeen.
